Acceptable Use Policy

This Acceptable Use Policy is provided by Say Mine Technologies Ltd. (“Mine”) and covers your use of Mine’s ‘MineOS’ platform and all additional privacy, security, and compliance services (“Services”).

This Acceptable Use Policy applies to your use of the Services when you, the end user, use the Services.

You acknowledge that you have been granted access to the Services by the organization you are working for or on behalf of such organization, who is a customer of Mine, as such terms defined under the applicable master service agreement or terms of service.

You will adhere to and comply with all applicable laws and regulations for your use of the Services.

Agreement to this Acceptable Use Policy

By accessing or using Services, you agree to be bound by this Acceptable Use Policy.

Please read this Acceptable Use Policy carefully.

If you do not agree to this Acceptable Use Policy, please do not use the Services.

Your access or use of Services constitutes your acceptance of this Acceptable Use Policy and your agreement to be bound by it.

Permitted Use of the Service

You will access and use the Services as permitted in this Acceptable Use Policy.

You will use the Services professionally and in accordance with instructions and procedures provided by the organization you are working for or on behalf of such organization.

You will use the Services to enhance and support your organization and further fulfill the objectives of the purpose of your organization’s subscription to the Services.

You are responsible for reporting promptly to Mine about any suspected security incident, theft, loss, or unauthorized use and access to the Services.

Prohibited Use of the Service

You will not use the Services in a manner that violates or compromises the instructions and procedures provided by the organization you are working for or on behalf of such organization.

You, or anyone on your behalf, will not use or attempt to misuse the Services:

  • to interfere with or disrupt the use of the Services or any part of the Services, or the equipment used to provide the Services;
  • to breach or circumvent any security or authentication measures;
  • to probe, scan, test the vulnerability of any system or disable, interfere with, or circumvent any aspect of the Services;
  • to intentionally distribute viruses, worms, trojan horses, corrupted files, hoaxes, or other materials of a destructive or deceptive nature;
  • to generate, distribute, publish, or facilitate unsolicited mass emails, promotions, advertisements, or other solicitations in any jurisdiction;
  • to infringe the intellectual property, privacy, or publicity rights of third parties, including by submitting, publishing, or sharing content without authorization;
  • to access the Services by any means other than our publicly supported interfaces or use any robot, scraper, or other automated means to access, use, or mirror the Services;
  • to engage in, promote, or encourage illegal activity;
  • to violate, or encourage the violation of, the legal rights of others including but not limited to infringing or misappropriating the intellectual property rights of others in violation of any applicable law or regulation;
  • to conduct any act that could constitute a criminal offense or give rise to civil liability;
  • for any unlawful, invasive, infringing, defamatory, illegal, fraudulent, unethical, or inappropriate purposes.

Compliance with this Acceptable Use Policy

Mine may suspend or terminate your access to and use of the Services, temporarily or permanently, if you engage in any violation of the terms of this Acceptable Use Policy.

Mine, at its own discretion, may:

  • report any activity violating the terms of this Acceptable Use Policy to the organization you work for;
  • disable access to or revoke the processing of any material provided to the Services that violates the terms of this Acceptable Use Policy;
  • intercept or block any activity violating the terms of this Acceptable Use Policy;
  • disclaim credits of the organization you are working for, as provided under the Service Level Agreement, due to any interruptions of Services resulting from your violation of the terms of this Acceptable Use Policy.

Compliance with Commercial Terms  

Mine grants you the right to access and use the Services solely for purposes set in the applicable master service agreement or terms of service, and subject to these legal terms.

Further, the scope and specification of your access and use of the Service may be subject to an applicable order form or statement of work. You will only access and use the Services in accordance with the terms and specifications of these documents.

The right to access and use the Services granted to you is contingent on your compliance with all applicable laws and regulations, as well as adherence to Mine’s policies.

Proprietary Rights

All rights, titles, and interests in Mine’s Services including all copyrights, designs, know-how, how-to-know, patents, trademarks, dress marks, trade secrets, and other intellectual property rights will be solely owned by Mine, including without limitation:

  • suggestions, ideas, and feedback provided by you to Mine;
  • usage data necessary for the provision, operation, and development of the Services;
  • aggregated statistics and performance information related to the provision, operation, and development of the Services.
